    THIS PROMOTION IS VALID ONLY IN THE 50 UNITED STATES, THE DISTRICT OF COLUMBIA AND CANADA (EXCLUDING QUEBEC). VOID IN DELAWARE, QUEBEC & WHERE PROHIBITED BY LAW.

    BY ENTERING OR OTHERWISE PARTICIPATING IN THIS PROMOTION, YOU AGREE TO THESE OFFICIAL RULES, WHICH ARE A CONTRACT, SO READ THEM CAREFULLY BEFORE ENTERING. THIS CONTRACT REQUIRES YOU TO INDEMNIFY AND TO RELEASE ALL CLAIMS AGAINST THE PROMOTION ENTITIES (AS DEFINED BELOW). BY ENTERING THE SWEEPSTAKES, YOU ARE AGREEING TO MANDATORY, BINDING ARBITRATION WITH NO CLASS RELIEF, AND TO A LIMITATION OF YOUR RIGHTS AND REMEDIES, INCLUDING ANY DAMAGES THAT YOU MAY RECOVER.

    The "Spoon EK9 Civic Type R" Giveaway (the "Sweepstakes") is intended for legal residents of the United States of America ("USA"), Puerto Rico or Canada and shall only be construed and evaluated according to USA law, Canadian law, and applicable state/province law. Do not enter this Sweepstakes if you are not a USA, Puerto Rico or Canada resident or are otherwise ineligible to enter in accordance with these Official Rules at the time of entry. By participating, entrants agree to abide by and be bound by these Official Rules and the decisions of the Sponsor, which are final and binding in all matters relating to the Sweepstakes. Winning the Grand Prize (as defined below) is contingent upon fulfilling all requirements set forth herein.

  2. ELIGIBILITY: This sweepstakes is open to legal residents of the 50 United States and the District of Columbia, who are 18 years of age or older as of the date of entry. The Sponsor, the Administrator, their respective parent companies, employees, officers, directors, subsidiaries, affiliates, distributors, sales representatives and advertising and promotional agencies, and the officers, directors, agents, and employees of each of the foregoing (collectively, the “Released Parties”), and members of their immediate families (defined as including their respective spouses, regardless of where they reside) or households (whe, biological, adoptive and step-parents, grandparents, siblings, children and grandchildren, and ether related or not) of any of the above are NOT eligible to participate in this Sweepstakes. Non-eligibility or non-compliance with any of these Official Rules will result in disqualification. Void in Delaware and where prohibited or restricted by law. (For the avoidance of doubt, any references in these Rules to Entrants shall also include the Entrants who are deemed the Winners (as defined below)).
  1. HOW TO ENTER: There are two ways to enter:
  • Purchase Entry: For every $1 spent on eligible products at Revhard Motors, you will receive one entry into the sweepstakes.
  • Mail-in Entry: To enter without making a purchase, send a 3x5 card with your name, complete mailing address, phone number, date of birth, and email address to: Revhard Motors Sweepstakes, 4840 Broadway, Denver, CO 80216. Limit one entry per household per day. All entries must be postmarked by August 25th, 2024 and received by August 27 v, 2024. Requests for confirmation of receipt of mail-in entries will not be acknowledged.
  • Each mail-in entry received with be worth five (5) Sweepstakes entries. If a mail- in entry is postmarked during a Bonus Entry Period, If a mail-in entry is postmarked during a Bonus Entry Period, it will be worth the multiplier designated by the Sponsor’s website. Example: 10X Bonus Period would equal fifty (50) entries.
  1. PROMOTION PERIOD: The Promotion begins at 12:00:00 AM Mountain Time (“MT”) on June 25th,2024 and ends at 11:59:59 PM MT on August 27th, 2024 (the “Promotion Period”). Sponsor’s computer is the official time-keeping device for the Promotion. In the event that the prize value is not met, the Sponsor reserves the right to extend the duration of the contest for an additional two (2) weeks, up to and including September 13th, 2024.
  2. PRIZE: One Grand Prize: A 1997 Honda Civic Type R (Spoon Sports demo vehicle) valued at approximately $50,000. The prize is non-transferable and no cash alternative will be offered.

    PRIZE CONDITIONS: By accepting the Grand Prize, the Winner agrees to release and hold harmless the Released Parties from and against any claim or cause of action arising out of participation in the Sweepstakes or receipt or use of the Prize. The potential Winner must sign and return to the Administrator, within seven (7) days of the date of notice or attempted notice is sent, an Affidavit of Eligibility, Liability & Publicity (if a USA resident) or a Declaration of Compliance (if a Canadian resident) in order to claim the Prize. The Winner may also be requested to complete an IRS W9 form (or W8-BEN for a Canadian resident). Note: The Affidavit sent to a potential Winner will require that the Winner provide their Social Security Number to the Administrator, which will be used solely for tax reporting purposes. The Winner will be responsible for all local, state, and federal taxes associated with the receipt of the prize. The Winner must note that the value of the accepted Prize is taxable as income and an IRS Form 1099 will be filed in the name of the Winner for the value of the Prize (applicable to USA Winners only). The Winner is solely responsible for all matters relating to the Prize after it is awarded. If a Prize or Prize notification is returned as unclaimed or undeliverable to the potential winner, if a potential Winner cannot be reached or does not comply with notification instructions within three (3) business days from the first notification attempt, if a potential Winner fails to return requisite document(s) within the specified time period, or if a potential Winner is not in compliance with these Official Rules, then such person shall be disqualified and, at Sponsor’s sole discretion, an alternate Winner may be selected.

    For Any Selected Canadian Winner: The selected Entrant must answer correctly without assistance of any kind, whether mechanical, electronic, or otherwise, a mathematical skill-testing question posed by mail or telephone. If the selected Entrant fails to correctly answer the question, he/she will be disqualified, and another Entrant will be randomly selected. The potential Winner who correctly answers the skill-testing question will be notified by telephone and/or mail and/or email at the Sponsors’ discretion using the contact information provided at the time of entry. If the potential Winner is determined to be less than the age of majority in his/her province of residence, then the potential Winner will be disqualified, and an alternate Winner will be selected in their place. By accepting the Prize, where permitted by law, the Winners grants to the Released Parties and those acting pursuant to the authority of Sponsor and the Released Parties (which grant will be confirmed in writing upon Sponsor’s request), the right to print, publish, broadcast and use worldwide IN ALL

    WITHOUT LIMITING THE FOREGOING, WITH THE EXCEPTION OF ANY WARRANTIES PROVIDED BY THE MANUFACTURER AND/OR THE DEALER, EVERYTHING REGARDING THIS PROMOTION, INCLUDING THE PRIZE AND THE WEBSITE, IS PROVIDED “AS IS” WITHOUT ANY WARRANTY BY SPONSOR OR ADMINISTRATOR OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WINNER ACKNOWLEDGES THAT SPONSOR AND ADMINISTRATOR HAVE NOT MADE NOR ARE IN ANY MANNER RESPONSIBLE FOR ANY WARRANTY, REPRESENTATION, OR GUARANTEE, EXPRESS OR IMPLIED, IN FACT OR IN LAW, RELATIVE TO ANY COMPONENT OF THE PRIZE OFFERED IN THIS PROMOTION, INCLUDING BUT NOT LIMITED TO ITS QUALITY, MECHANICAL CONDITION OR FITNESS FOR A PARTICULAR PURPOSE, AND THE PRIZE VEHICLE MAY NOT MEET SAFETY OR EMISSIONS TESTING REQUIRED IN SOME STATES, AND/OR COUNTIES/MUNICIPALITIES.   1. WINNER SELECTION AND NOTIFICATION: A random live stream drawing will be conducted by an independent sweepstakes administrator approximately one week after the entry period ends. The potential winner will be notified via email and phone. The winner must respond within 72 hours to claim the prize. If no response is received, an alternate winner will be selected.

    WINNER LIST REQUEST: The name of the official winner will be announced at www.revhardmotors.com on or about August 30th, 2024 or after the winner has been verified.
  1. ODDS OF WINNING: Odds of winning depend on the number of eligible entries received.
  2. GENERAL CONDITIONS:
  • By participating, entrants agree to be bound by these Official Rules and the decisions of the Sponsor and Administrator, which are final and binding in all respects.
  • Sponsor reserves the right to disqualify any individual found to be tampering with the entry process or the operation of the sweepstakes, or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner.
  1. TAXES: All federal, state, and local taxes associated with the receipt or use of any prize are the sole responsibility of the winner.
  2. PUBLICITY: Except where prohibited by law, participation in the sweepstakes constitutes winner's consent to Sponsor's use of winner's name, likeness, photograph, voice, opinions, and/or hometown and state for promotional purposes in any media, worldwide, without further payment or consideration.
  3. LIMITATIONS OF LIABILITY: Sponsor is not responsible for: (a) any incorrect or inaccurate information, whether caused by entrants, printing errors, or by any of the equipment or programming associated with or utilized in the sweepstakes; (b) technical failures of any kind; (c) unauthorized human intervention in any part of the entry process or the sweepstakes; (d) technical or human error which may occur in the administration of the sweepstakes or the processing of entries; or (e) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the sweepstakes or receipt or use or misuse of any prize.

    ANY FRAUDULENT ACTIVITY IN CONNECTION WITH THIS PROMOTION IS STRICTLY PROHIBITED. IT IS FRAUDULENT TO PURCHASE ITEMS TO OBTAIN ENTRIES WITH THE INTENT TO RETURN THESE ITEMS AFTER THE PROMOTION. IF THE SPONSOR IDENTIFIES OR SUSPECTS THAT YOU ARE ENGAGED IN THIS OR ANY OTHER FRAUDULENT ACTIVITY, YOU WILL BE DISQUALIFIED AND BANNED FROM ANY FURTHER SWEEPSTAKES OR PROMOTIONS OFFERED BY THE SPONSOR.
  1. DISPUTES: Except where prohibited, entrant agrees that: (a) any and all disputes, claims and causes of action arising out of or connected with this sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in Colorado; and (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this sweepstakes, but in no event attorneys' fees.
  2. PRIVACY: Information collected from entrants is subject to the Sponsor’s privacy policy.
  3. SEVERABILITY: If any term or provision of these Official Rules is found under the law to be invalid or unenforceable, then such specific term or provision shall be of no force and effect and shall be severed, and the remainder of these Official Rules shall continue in full force and effect.
  4. DISPUTES: all issues and questions concerning the construction, validity, interpretation and enforceability of these official rules or the rights and obligations of entrants, administrator, and sponsor in connection with the sweepstakes shall be governed by and construed in accordance with the laws of the state of Colorado, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other state’s or jurisdiction’s laws. by participating in the sweepstakes, entrant agrees that: (i) ANY AND ALL DISPUTES, CLAIMS, AND CAUSES OF ACTION ARISING OUT OF OR IN CONNECTION WITH THE SWEEPSTAKES, SHALL BE RESOLVED INDIVIDUALLY WITHOUT RESORT TO ANY FORM OF CLASS ACTION; (ii) ANY JUDICIAL PROCEEDING SHALL TAKE PLACE IN A FEDERAL OR STATE COURT WITHIN THE STATE OF COLORADO; (iii) ANY AND ALL CLAIMS, JUDGMENTS, AND AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS INCURRED, INCLUDING COSTS ASSOCIATED WITH ENTERING THIS SWEEPSTAKES, BUT IN NO EVENT WILL ATTORNEY FEES BE AWARDED OR RECOVERABLE; (iv) UNDER NO CIRCUMSTANCES WILL ENTRANT BE PERMITTED TO OBTAIN AWARDS FOR, AND ENTRANT HEREBY WAIVES ALL RIGHTS TO SEEK, PUNITIVE, INCIDENTAL, EXEMPLARY, CONSEQUENTIAL, SPECIAL DAMAGES, LOST PROFITS, OTHER DAMAGES, AND/OR ANY RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED; AND (v) ENTRANT’S REMEDIES ARE LIMITED TO A CLAIM FOR MONEY DAMAGES (IF ANY) AND HE/SHE WAIVES ANY RIGHT TO SEEK INJUNCTIVE OR EQUITABLE RELIEF.
